By making a purchase from sKayKrafts, whether through the online shop, invoicing, bank transfer, or any other type of payment, you agree to the terms and conditions outlined below. These terms are designed to comply with UK law, ensuring clarity and fairness in all transactions.

1. Customer Service Commitment

At sKayKrafts, I strive to provide excellent customer service, ensuring that each commission is an enjoyable and straightforward experience. Should any issues arise, I will always be available to help and resolve them promptly.

2. Commissions

I reserve the right to decline any commission if I believe it is inappropriate or if I feel unable to meet the specific expectations of the commission. In the event you have already made a purchase and I am unable to proceed with the commission, your payment will be refunded in full. Refunds typically take 2-7 business days to appear in your account, depending on your bank.

3. Artwork and Copyright

All copyright and reproduction rights of any artwork, including commissioned work, remain with the artist (sKayKrafts). By commissioning work from me, you grant permission to use your reference images for the creation of the artwork and the right to display the artwork across various platforms (e.g., advertisements, website, and social media).

If you prefer that the artwork not be displayed publicly, please inform me prior to booking. If you wish to have the artwork displayed after a specific date (e.g., a birthday), I am happy to accommodate this upon request.

4. Turnaround Time

Turnaround times are estimates and may vary. Although I aim to meet deadlines, they are not guaranteed, and you are not entitled to a refund if a commission is completed after the estimated time. If you need the artwork by a specific date, such as for a special occasion, I recommend booking at least 6-12 months in advance. Once the artwork is completed, final payment must be made within 12 months, after which the portrait will be discarded if payment is not received.

5. Cancellations

All payments, including full payments and deposits, are non-refundable. If you cancel after paying in full or do not wish to receive the portrait, you are not entitled to a refund. However, the artwork will be completed and sent to you unless you explicitly request otherwise. Completed artworks will be stored for 12 months if you decide not to receive them.

In the unlikely event that I am unable to fulfil a commission, you will be entitled to a full refund.

6. Shipping and Delivery

Shipping is available to UK addresses only, including the Isle of Man. It is your responsibility to provide an accurate shipping address. If the address provided is incorrect and the artwork is delivered to that address, sKayKrafts is not liable, and no refund will be issued.

In the rare case that an artwork is sent to the wrong address due to an error on my part, you will receive either a full refund or a replacement artwork at the earliest available time. Parcels are shipped via Royal Mail or Parcelforce and are fully insured for the value of the artwork.

If your parcel is lost, a claim will be submitted to the courier for compensation. Refunds will only be issued after the claim is accepted. This process may take several weeks, but you will be kept informed throughout.

7. Returns

As all commissioned artworks are custom-made, they are non-refundable and non-returnable. If your artwork arrives damaged, you must notify me with photographs of the damage within 3 days of receipt. I will initiate a compensation claim with the courier. Refunds will only be processed once the claim is accepted, which may take several weeks.

If only the mount (but not the artwork itself) is damaged, I can either remount the artwork for you or recommend remounting it yourself. I will reimburse return postage costs for remounting and cover the cost of the new mount and return shipping.

8. Pricing

Prices may change at any time, typically once a year, to reflect the rising costs of quality materials and the advancement of professional skills. All prices include VAT where applicable.

9. Consumer Rights

Under UK consumer law, you are entitled to certain statutory rights, which are not affected by these terms. For further information about your rights, visit the UK Government’s website regarding the Consumer Rights Act 2015.
